Occupational Health & Safety

Changes in the Work Health and Safety Act place a “duty of care” on employers, and any party in control of a place of work, with the emphasis on providing a safe environment for employees and the general public. Parties in control of a place of work include tenants and landlords. Individuals also have a “duty of care” under the Work Health and Safety Act. Individuals, as well as employers and landlords can be held responsible for failing to meet a “duty of care”.

Building Code of Australia (BCA)

The Building Code of Australia requires that safety measures perform to a standard not less than they were originally required to achieve. Failure to maintain fire safety equipment is deemed a failure to meet the “duty of care” requirements.

Environmental Planning & Assessment Act (NSW)

The Environmental Planning and Assessment Act requires that Safety Measures perform to a standard not less than they were originally required to achieve, and annually certified. Failure to maintain fire safety equipment is deemed a failure to meet the “duty of care” requirements.

Public Health Regulations and Public Health Act

Public Health Regulations and the Public Health Act place “duty of care” requirements on building owners and managers. These requirements include the control of Legionella Bacteria.

Industry Best Practices

Industry Code of Good Practice is the minimum acceptable practice within an industry. Industry Best Practices goes beyond Industry Code of Good Practice. Industry Best Practice can be set by default. If an improvement can be made in any area, Best Industry Practice has not been achieved. Failure to adopt “Industry Best Practices” could be deemed a failure to meet the “duty of care” requirements.

Australian Standards

Australian Standard – AS1851 – 2012 requires specific periodic maintenance regimes, dependent on each essential service, i.e. weekly, monthly, 3 monthly, 6 monthly, annually, three yearly, 6 yearly and 24 yearly. Failure to conduct tests is deemed a failure to meet the “duty of care” requirements.

Australian Standard – AS1851 – 2012 requires the owner(s) of a building to arrange for an Annual Compliance Survey to be conducted on the building’s Fire Safety Measures (essential services). The Annual Compliance Survey will produce an Annual Condition Report. The building owner will issue an Annual Fire Safety Statement that will include a statement that on the date on which it was inspected it was found to have been maintained, and to be capable of operating (performing) at a standard not less than that to which it was originally designed and installed. Failure to produce an “Annual Fire Safety Statement” would be deemed a failure to meet the “duty of care” requirements.

Australian Standard – AS3666 requires monthly inspections, and if required, cleaning of air conditioning components. Failure to do so is deemed a failure to meet the “duty of care” requirements.

Other Australian Standards state specific performance and maintenance criteria which places additional “duty of care” requirements on building owners and managers.
